A man was stabbed at the Adventureland Amusement Park on Long Island, New York following an altercation between two families, police said. The incident occurred earlier this month in front of several children.
Suffolk County Police reported that Daniel Tomasky, 42, allegedly stabbed James Burns, 47, in the stomach near the Mystery Mansion ride. Burns, a Florida resident, was taken to a hospital in serious condition and underwent emergency surgery. He remains in critical, but stable condition.
Tomasky's 5-year-old son along with four other children witnessed the attack, according to court documents.
Tomasky was arrested and held overnight. If convicted, he could face anywhere from 5to o 25 years in prison. He pleaded not guilty on Monday to charges including assault with intent to cause serious injury, criminal possession of a weapon, and child endangerment.
Tomasky's lawyer, Robert Macedonio, asked for $25,000 bail. The defense said Burns had attacked Tomasky's wife during the altercation, leaving her unconscious.
"My client maintains his innocence here," Macedonio said. "He has not had a felony in over a decade and has never failed to appear in court."
According to prosecutors, video footage showed Tomasky trying to hide the weapon in a sewer after the incident. Judge Jonathan Bloom requested $100,000 bail, mentioning Tomasky's six prior convictions.
Judge Bloom set bail at $50,000 cash or $100,000 bond. He issued protective orders for three of the minor witnesses and Burns, but not for Tomasky's child.
Brookhaven Town Supervisor Dan Pacino, who was at the park with his family, described the scene on Facebook: "Walking from the antique car ride area of the park, I saw a man sitting on a picnic bench bleeding and clenching his abdomen just after being stabbed."
Witness Jessie Hagelstein told News 12, "This is a children's amusement park, and families are just coming here with their kids to have a good time."
